MEMORANDUM ON THE OBJECTS OF THE LOCAL GOVERNMENT: 1.2 Municipalities derive their power to levy property rates directly from the Constitution (see in this regard section 229(1) of the Constitution). "Property" is not defined in the Constitution and is construed in context to mean land including any immovable property on or in the land or under the surface of the land.
